Throughout the normal life of a trade union, as it evolves and the environment changes, its executives and members may find it necessary to modify its constitution. However, these changes cannot be made by the trade unions in isolation. In order to effect these changes, the executives must first get approval from the registrar of trade unions.
In order to effect constitutional amendments, the trade union must have the support of the majority of its membership for the proposed changes.
- Print and sign two copies of every resolution, in respect of each applicable by-law or section, for the alteration of their constitution. The person signing must be an officer of the trade union.
- Submit the resolutions along with the sample ballot to be used for general membership’s voting on the amendments.
- Take resolutions to general membership for voting. Please note that this must be presided over by the registrar of trade unions.
- Print and sign a statutory declaration stating that the requirements of the constitution regarding amendments have been complied with.
- Submit these documents to the registrar of trade unions.
Please note that amendments do not take effect until the trade union has received confirmation of same by way of a returned copy of the resolutions submitted, signed and stamped by the registrar of trade unions.
